Choose an answer, then open the working. Each explanation says why the right answer is right and why the others are not.
A design engineer finds that a dryer his firm has already sold to many farmers can overheat and start fires under a foreseeable operating condition. His manager tells him to stay silent until the next model. What should he do first?
D. Report the hazard in writing to management with the evidence and a proposed remedy
The engineer's duty is to protect public safety. The first step is to raise the concern clearly in writing within the organisation, with evidence and a remedy. If management refuses to act on a real danger, the codes require him to notify the appropriate authority. Public posting before using proper channels, or removing confidential files, is not the right first step.
Which of the following is NOT an essential element of a valid contract in common-law systems?
A. A written document signed in front of a notary public
Offer, acceptance, consideration, capacity, free consent, lawful object and certainty are essential. Most contracts need not be in writing or notarised, although some kinds, such as land transfers, must be in writing under particular statutes.
An irrigation canal is to be excavated where the volume of rock is very uncertain. Which contract type places the risk of quantity variation mainly on the owner?
B. An item-rate contract paid on actual measured quantities
In an item-rate contract the contractor quotes rates and is paid for quantities actually measured, so the owner bears the risk of quantities. Lump-sum, EPC and fixed-price design-build contracts place quantity risk on the contractor and need a well-defined scope.
Which FIDIC standard form is intended for engineer-procure-construct (turnkey) projects in which the contractor takes most design and construction risk?
C. The Silver Book
FIDIC's Silver Book is for EPC/turnkey projects. The Red Book is for construction designed by the employer, the Yellow Book for plant and design-build, and the Green Book is a short form for simple or low-value work.
In a two-envelope tender for an irrigation pump station, what is the correct procedure?
B. Evaluate technical bids first, then open only responsive bidders' prices
The two-envelope system separates technical evaluation from price, so price does not influence the technical judgement. Only technically responsive bids proceed to financial opening, and works are usually awarded to the lowest evaluated responsive bid.
In specifications and standards written to ISO drafting rules, which verbal form expresses a mandatory requirement?
B. Shall
'Shall' states a requirement; 'should' a recommendation; 'may' a permission; 'can' a possibility or capability. Writing 'should' where a requirement is intended weakens the owner's position.
A firm designs a tractor with a distinctive bonnet shape that does not affect how the tractor works. Which right best protects the shape?
B. Registration as an industrial design
Industrial design rights protect the appearance of a product, its shape, configuration, pattern or ornament. Patents protect functional inventions; plant variety protection applies to plants; a visible shape cannot be kept secret.
Which plant-variety criteria are tested in a DUS examination?
B. Distinctness, uniformity and stability
Under UPOV and similar systems, a protectable variety must be new and distinct, uniform and stable (DUS), and have an acceptable denomination. Yield or disease resistance may be valuable but are not the DUS criteria.
Which four elements must normally be shown to establish negligence?
D. Duty of care, breach of that duty, causation and damage
Negligence requires a duty of care, a breach by falling below the required standard, causation linking the breach to the harm, and damage that is not too remote. Intent is not required, and negligence can arise without any contract.
What is the correct order of preference for dealing with a hazard on a machine?
A. Eliminate by design, then guard, then warn and instruct, then personal protective equipment
The hierarchy of risk reduction puts inherently safe design first, safeguarding second, information for use third and PPE last. Warnings cannot substitute for a feasible safe design or a guard.
